1. Acceptance of Terms

By accessing and using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

2. Accounts

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

3. Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
Our payment processing is handled by Paddle, our merchant of record. By subscribing, you also agree to Paddle's Terms of Service and Privacy Policy.

4. Free Trial

Focus App may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for the Free Trial.

5. Fee Changes

Focus App, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

6. Refunds

Full refunds are available within 7 days of purchase - if less than 7 tasks have been completed. Email us at hellopomodorotimer@outlook.com to request a refund. Please note that refund requests may be processed through Paddle, our payment processor, and are subject to their policies.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

8. Privacy Policy

We are committed to protecting your privacy. Our Privacy Policy, which should be read in conjunction with these Terms, outlines how we collect, use, store, and protect your personal information. Key points include:

• Data Collection: We collect information necessary to provide the Service, such as account details and usage data.
• Payment Processing: Subscription payments are processed by our Merchant of Record, Paddle. When you subscribe, your payment information is handled directly by Paddle according to their Privacy Policy. We do not store your full payment card details.
• Data Usage: We use your data to operate and improve the Service, communicate with you, and fulfill legal obligations.
• Data Sharing: We may share data with third parties like Paddle for essential service functions (e.g., payment processing).
• Your Rights: You have rights regarding your personal data under applicable law (e.g., access, correction, deletion).

9. Prohibited Uses

You agree not to use the Service for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Service in any way that could damage the Service, Focus App, Paddle, or general business operations. Prohibited uses include, but are not limited to:

• Harassing, abusing, or threatening others or otherwise violating any person's legal rights.
• Violating any intellectual property rights of Focus App or any third party.
• Uploading or otherwise disseminating any computer viruses or other software that may damage the property of another.
• Perpetrating any fraud.
• Engaging in or creating any unlawful gambling, sweepstakes, or pyramid scheme.
• Publishing or distributing any obscene or defamatory material.
• Publishing or distributing any material that incites violence, hatred, or discrimination towards any group.
• Unlawfully gathering information about others.

10. Limitation of Liability

In no event shall Manh Nguyen (doing business as Focus App), nor any associated partners, agents, or suppliers, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use, the Service.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.
